Legal / Electronic Communications Consent

Electronic Communications Consent

Version 5.0.0 · Effective 2026-10-18 · Operator Nativity Ltd

At a glance

  • You agree to receive contracts, notices, and disclosures electronically.
  • We send transactional email (security, account, and product-operational messages) through our Email Delivery Provider.
  • Browser push is optional and only if you grant permission.
  • Marketing messages, if we send any, include an unsubscribe control. Transactional and security mail does not, and cannot be turned off while you have an account that needs it.
  • We do not use SMS as a default channel.
  • Keep the email address on your account current. Email is deemed received when we send it to that address.
  • Need an accessible format? Write to [email protected].

1. Agreement

This document explains how Nativity Ltd (Optimal, Optimal Being) communicates with you electronically when you use the Services at https://beingoptimal.org and related domains.

By creating an account, agreeing to the Terms of Service, or continuing to use the Services after notice of this document, you agree to the terms below to the extent permitted by law. This consent is incorporated into the Terms. Defined terms follow the Definitions.

2. Receiving

You agree that we may provide the following electronically rather than on paper:

  • Legal documents in this suite, including Terms, Privacy Policy, Cookie Policy, this consent, and related policies, as well as updates and re-acceptance prompts.
  • Notices about material changes that affect your rights.
  • Account suspension, termination, or enforcement notices.
  • Responses to privacy or consumer rights requests, as appropriate.
  • Other disclosures the law allows us to deliver electronically.

While you have an account or use the Services, we may also send:

  • Security messages, such as sign-in alerts, password resets, suspicious activity, by email, from our Authentication Provider and/or Email Delivery Provider.
  • Account messages, such as welcome, provisioning, deletion confirmations.
  • Product-operational messages, such as sync issues, entitlement changes, maintenance, by email and/or in the product.
  • Billing messages, such as receipts, renewals, failed payment, if you have a paid plan, from us and/or the Billing Provider.
  • Support replies to requests you open.
  • Push reminders or product notices you have enabled, and offers from sponsors if you chose them (off until you turn them on in the Privacy Center).

If you use community or learning features, you may also receive forum notifications under settings you control on https://community.beingoptimal.org.

3. Sending

Email. Transactional email goes through our Email Delivery Provider. Messages may include your address and limited account or notification content. Retention follows the Privacy Policy and the provider’s practices. Template design may use an Email Design Provider.

In-product. We may show banners, dialogs, or account-page notices.

Push. Optional notices use browser Web Push. Enabling them requires browser permission. See the Cookie Policy.

Authentication Provider. That provider may send its own authentication emails, such as verification, magic links, security. Those messages are part of using our sign-in system.

No default SMS. We do not rely on SMS as a primary channel. If we add SMS, we will obtain any required consent and update this document.

Marketing. Promotional email, if any, will be sent only where the law allows and, where required, with separate consent. Marketing mail will include an unsubscribe mechanism. Unsubscribing from marketing does not stop security or account-critical mail.

4. Hardware & Software

To receive electronic communications you need internet access, a current browser that can use the Services (and, for push, one that supports Web Push), a valid email address you control, and enough storage if you want to keep copies. If you cannot meet these requirements, you may be unable to contract electronically for the Services. Contact [email protected] or [email protected] for accessibility options.

5. Updated Email

You agree to provide a valid email address when you register, keep it current in your account, and reasonably monitor that inbox and spam for security and account messages.

Except where mandatory law says otherwise, we are not responsible for harm caused by your failure to maintain a working address.

6. Legal Effect

You consent to receive the communications described here in electronic form. Where the law allows, your electronic agreement to the Terms and related policies has the same legal effect as a handwritten signature, including under the U.S. ESIGN Act and UETA, and analogous laws elsewhere.

We may keep electronic records of acceptances, notices, and key transactional emails as needed for legal, security, and operational purposes.

7. Withdrawal, Paper, Accessibility

Withdrawal of electronic delivery. You may withdraw consent to electronic delivery of legal notices by contacting [email protected] or [email protected]. Because the Services are digital, we may not be able to keep providing them if you withdraw. Withdrawal does not undo notices already delivered electronically. Security email may still be necessary while an account is wound down.

Marketing. You may unsubscribe from marketing emails via the link in those emails without closing your account.

Push. Disable notifications in your browser or operating system and/or in product settings. Clearing site data or closing your account also stops push, subject to the Privacy Policy.

Paper is not the default. On request, email [email protected] for a specific legal document. We may send a link to the current policy on https://beingoptimal.org or a reasonable copy when we can. We may refuse unreasonable bulk requests, and we may charge a fee only where the law allows for repeat paper fulfillment.

Accessibility. If you need communications in an accessible format, please contact [email protected] or [email protected]. See the Accessibility Statement.

8. Message Receipt

Except where mandatory law requires a different rule:

  • Email is deemed received when sent to the address on your account, or when made available, for provider-hosted authentication messages, whether or not you open it.
  • In-product notices are deemed received when displayed in the Services.
  • Push is deemed received when delivered to the push service for your subscription. Whether your device actually shows it depends on your device settings.

Processing of email addresses, notification content, and related metadata is described in the Privacy Policy. Provider roles are listed in the Sub-processor List.

If this document conflicts with the Terms on communications delivery, this document controls that topic. Billing-message content may also follow the Subscription, Billing & Refund Policy. Mandatory consumer law prevails.

9. Changes

We may update this document. Material changes will be noticed electronically. Continued use after the effective date is acceptance where the law allows.

See also the Terms of Service and Cookie Policy.
